in order to save human life in an emergency.”
For illustration:
“assume a Ham and his wife are driving and have an auto
accident. The Ham operator (husband) dies on impact.
The wife is going to bleed to death without immediate medical
attention, but she is not a licensed Ham operator. The Ham
radio is working and she can reach it. The cell phone has no
reception. Issue: Can the wife use the Ham radio to call for
help?
The answer is either: Yes, or No.”

“…an
unlicensed individual may not operate an amateur radio under any
circumstances. If they do so, they are in violation of the
Communications Act and the Commission’s rules and subject to a
possible enforcement action”.

showing that a non
– licensed person can use Ham Radio in an emergency involving
safety of life.
The
response also illuminates that the standard of
reasonableness is to be used in evaluating the use of
Ham Radio taking into account the circumstances.
Further, a case by case evaluation is made of
the circumstances; and a fact
specific determination is made as to the existence of
an emergency. Such further confirmed that the
prior statements made by various persons at the FCC advising that
“there is no provisions in the Rules that would allow unlicensed
use in the amateur bands”, were erroneous and not correct.

"Situation F. A HAM radios into a Repeater for a 911 relay for his wife who has fallen on
chain saw with severe lacerations, and is bleeding out. The only person who hears the call is a
NON HAM who is monitoring the repeater. No location yet given.
Does the Non Ham handle the traffic or ignore ?
SMITH FCC unlawful dictate: since the Non Ham doesn’t have an FCC call
sign THE NON HAM CAN’T USE THE REPEATER. "
CONTROL OPERATOR PER SMITH FCC MUST TURN OFF THE REPEATER.
SMITH FCC IS MANDATING THAT THE CONTROL OPERATOR COMMIT A CRIME
(MISDEMEANOR OR FELONY). SEE CALIFORNIA PENAL
